Acceptance of these terms

By downloading, installing, or using the Moonsync app ("the app", "we", "us", "our"), you agree to these Terms of Service ("Terms"). If you do not agree with these Terms, please do not use the app. These Terms form a binding agreement between you and Moonsync.

What Moonsync is

Moonsync is a mobile application that displays real-time lunar phase information, biodynamic gardening guidance, and provides optional cycle tracking functionality. All personal data entered into the app is stored locally on your device. The app may include premium features that can be unlocked through a paid subscription.

Eligibility

You must be at least 13 years of age (or the age of digital consent in your country, whichever is higher) to use Moonsync. If you are under 18 (or the age of majority in your jurisdiction), you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

Subscriptions and payments

Some features of Moonsync are available only through a premium subscription or one-time purchase. The current pricing and available plans are shown within the app and on the relevant app store listing.

How purchases work. All purchases are processed by Apple (App Store) or Google (Google Play). Moonsync does not receive your payment information directly. Refunds, billing disputes, and payment-related issues are handled by the platform you purchased through.

Automatic renewal. Subscriptions renew automatically at the end of each billing period unless you cancel them at least 24 hours before the end of the current period. You can manage and cancel subscriptions through your device's App Store or Google Play account settings.

One-time purchases. Lifetime or one-time unlocks are not subscriptions and do not renew. They are non-refundable except as required by law or as offered by the relevant app store.

Price changes. If we change our subscription prices, you will be notified before the change takes effect. Continued use of a subscription after a price change constitutes acceptance of the new price.

Acceptable use

You agree to use Moonsync only for lawful purposes and not to:

• Reverse engineer, decompile, or attempt to extract the app's source code or proprietary content
• Use the app in a way that could damage, disable, or impair its functionality for other users
• Use the app to violate any applicable law or regulation
• Attempt to access features or content you have not paid for through unauthorised means
• Resell, redistribute, or sublicense the app or any of its content

Moonsync is provided for general interest and entertainment purposes. Information presented in the app, including cycle tracking, biodynamic gardening guidance, lunar event predictions, and astrological content, is not medical, scientific, or professional advice.

The app's cycle tracking feature is intended as a personal logging tool. It should not be used as a method of contraception, a diagnostic tool, or a substitute for professional medical advice. If you have health concerns or questions about your menstrual cycle, fertility, or reproductive health, please consult a qualified medical professional.

Lunar phase, zodiac, and biodynamic gardening information is provided for cultural and traditional interest. Outcomes from following any guidance in the app are not guaranteed.

Intellectual property

The Moonsync app, including its design, code, written content, graphics, and branding, is the property of Moonsync. You are granted a limited, non-exclusive, non-transferable licence to use the app on devices you own or control, for personal non-commercial use only.

This licence does not transfer ownership of any intellectual property to you, and all rights not expressly granted are reserved.

Third-party services

Moonsync uses limited third-party services for crash reporting and anonymous analytics. These are described in our Privacy Policy. Your use of these services through Moonsync is also subject to their respective terms.

Disclaimer of warranties

Moonsync is provided "as is" and "as available", without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

Like all software, Moonsync is provided without guarantees about uninterrupted operation, freedom from bugs, or absolute security. While we work hard to keep the app reliable, we cannot guarantee that every feature will work perfectly on every device or that the app will be free of all errors at all times.

Limitation of liability

To the fullest extent permitted by law, Moonsync is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the app, including but not limited to loss of data, loss of profits, or device damage.

Our total liability to you for any claim arising from these Terms or your use of the app is limited to the amount you paid for the app or its subscriptions in the twelve months preceding the claim.

These limitations do not affect any non-excludable rights you may have under your local consumer protection laws, including the New Zealand Consumer Guarantees Act 1993 where applicable.

Changes to the app

We may update, modify, or discontinue features of the app at any time. We will make reasonable efforts to communicate significant changes through the app or through these pages. We are not liable for any loss or inconvenience resulting from changes to the app.

Termination

You may stop using the app at any time by uninstalling it from your device. We may suspend or terminate access to the app if you breach these Terms or if required by law. Upon termination, your right to use the app ends immediately, but uninstalling the app does not refund any active subscriptions — those must be cancelled separately through your app store.

Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top will reflect any changes. Material changes will be communicated through the app or these pages. Continued use of the app after changes to these Terms constitutes acceptance of the updated Terms.

Governing law

These Terms are governed by and construed in accordance with the laws of New Zealand. Any disputes arising from these Terms or your use of the app will be resolved in the courts of New Zealand, except where local consumer protection laws in your jurisdiction give you the right to bring proceedings in your local courts.
